VA connected-records terms of service
VIPCall.ai — GetMotivatedBuddies, Inc.
Last updated: October 8, 2026
This document applies to VIPCall users who connect records from the U.S. Department of Veterans Affairs. It replaces the general VIPCall terms of service for those users. These commitments cover all of your VIPCall user data, including VA and non-VA data. General retention periods or backup exceptions do not extend the 45-day deletion deadline. Other users continue to use the general VIPCall terms of service.
GetMotivatedBuddies, Inc. provides VIPCall. These terms apply to VIPCall's website, care-record features, calls, messages, and connected health records. They form an agreement between you and GetMotivatedBuddies, Inc. Read the privacy policy at https://vipcall.ai/privacy/va with these terms.
These terms include binding arbitration and an agreement to bring claims individually, subject to the exceptions below. Read the section on disputes before agreeing to use VIPCall.
Read the VA connected-records privacy policy.
Who can use VIPCall
You must be able to enter a binding agreement. If you are below the age of majority where you live, you need a parent or legal guardian's consent. The service is not intended for anyone under 13, or under 16 in the European Union.
If you act for a company or another person, you must have authority to do so. You must also have the permission needed to enter, connect, or share another person's information. You must not use VIPCall if you are prohibited from using it by law or by a valid account suspension.
Your account
Give us accurate account information and keep it current. Protect your sign-in details and tell us if you suspect someone used your account without permission. You are responsible for activity you authorize through the account.
Do not impersonate someone, use another person's account without permission, or give misleading information about your authority to act for a person. Account access does not by itself prove a legal right to a medical record.
What VIPCall does
VIPCall helps you and authorized caregivers organize information and coordinate care. Features can include care records, medication and appointment information, tasks, phone check-ins, messages, recordings, transcripts, summaries, and documents.
Service is for educational and informational purposes, not clinical decisions.
VIPCall does not diagnose, prescribe, treat, or replace a clinician. It is not an emergency service. For an emergency in the United States, call 911. Do not wait for a VIPCall call, message, or alert to get urgent help.
A call or automated alert can fail, be delayed, or miss important information. AI output can be inaccurate or incomplete. Check information against the original source and a qualified professional before relying on it for care.
We do not currently claim HIPAA compliance. Whether a particular law applies depends on the service and relationship involved. These terms do not waive a legal duty that applies to us.
Health connections and records
You choose whether to authorize a health connection. Access depends on the source, your authority, and the permissions granted. We may import and store the records covered by that permission so you can use them later in VIPCall.
Only connect records you have a right to access. Confirm that the selected person is the person whose records you intend to connect. If the identity or record is wrong, stop and contact support before sharing or acting on it.
Imported information can be incomplete, out of date, or different from the hospital's current record. An edit in VIPCall does not necessarily change the hospital's record. A source can withdraw access or change its service, and we cannot promise that every record will always be available to reimport.
Imported-record AI is currently disabled while provider retention compatibility is unresolved. We will not introduce a new use of health information that requires consent until that consent is obtained.
Disconnecting a source stops future access. It does not automatically delete records already imported. Use the permanent-deletion controls when you want those records erased.
Calls, recordings, and messages
You must have the permission required to call or message a person, record a conversation, and share a resulting update. Explain the service to the people you enroll and respect their choices about participation.
Calls may use an AI voice and may be recorded, transcribed, and summarized as described in the privacy policy and the consent for the feature. Telecom and AI providers process the information needed to deliver those features.
You can manage available call settings and message preferences. Scheduled calls and manual calls can have different controls. Pausing scheduled calls is not a request to erase records. A person can withdraw permission for future contact without waiting for a subscription to end.
You are responsible for charges from your own phone or internet provider. Delivery and call connection depend on systems outside VIPCall as well as our service. We do not guarantee that every call or message will reach its recipient.
Sharing with other people
Check a person's identity and access before sharing information. Invite only people you intend to authorize. Do not share information about another person without authority to do so.
Care records can include details about relatives, including genetic or family history. Sharing a record may affect people other than the account holder. Choose the scope of sharing with that risk in mind.
You are responsible for your interactions with other users. We do not guarantee another user's identity, conduct, skills, or fitness to provide care. We do not conduct a background check on every user. Do not send money or payment details to another user through a care record or message.
Your content and our permission to use it
You keep your rights in the content you provide. You give us permission to host, copy, process, transmit, and display it as needed to provide the features you request, protect the service, and meet applicable duties. This permission does not authorize sale of your data or an unrelated use of health information.
You must have the rights needed to provide the content. Do not submit content that infringes someone else's rights, breaks the law, or violates these terms. You are responsible for the accuracy of information you add and for your authority to share it.
The permission to process content is subject to your consent choices and the privacy policy, including its deletion commitment. We do not obtain a perpetual right to keep deleted medical information because you once uploaded it.
Acceptable use
Do not harass, threaten, abuse, defraud, or unlawfully discriminate against anyone. Do not post illegal material, disclose private information without authority, or misuse a person's health information.
Do not send spam, malware, deceptive messages, or content that unlawfully infringes intellectual property rights. Do not use VIPCall to promote an illegal activity or to collect information about another person without permission.
Do not bypass access controls, interfere with the service, or try to access another account's data. Do not probe or test the service without authorization. Report a suspected vulnerability privately to support@vipcall.ai and avoid accessing other people's information.
We may remove content or restrict access when needed to address a violation, protect people or the service, or comply with law. We will not treat a privacy or deletion request as an acceptable-use violation.
Plans, payment, and cancellation
The plan, price, trial, billing period, and any other payment conditions shown when you subscribe apply to your purchase. Do not assume every plan has the same features or limits.
You authorize the recurring charges you agree to at checkout until you cancel under the applicable plan terms. Keep your payment information current. Stripe processes payments on our behalf.
You can cancel a subscription through the available account billing controls or contact support if you cannot access them. Cancellation and refunds follow the purchase terms and any rights required by law. A failed payment may restrict paid features.
Cancelling payment is different from requesting permanent data deletion. An account or care record may remain available after a subscription ends under the privacy policy. Request permanent deletion if you want your data erased.
Keeping and deleting information
We keep your account and care information while your account remains open and you have not requested deletion. Dormant accounts follow the same rule. There is no fixed inactivity purge date, and stopping website sign-ins alone does not erase your care record.
You can request deletion at any time. Open Account settings, choose Profile settings, and find Permanent data deletion. Enter DELETE and select Request permanent deletion. If you cannot sign in, email support@vipcall.ai for the identity-verification process.
We will permanently delete 100% of your user data held by VIPCall and its service providers, including VA and non-VA data, within 45 days of your original request. Retrying does not restart the deadline. The privacy policy explains the scope, provider copies, backups, and handling of independently owned shared records.
An archive is reversible and is not permanent deletion. Encryption does not make a backup exempt from the deletion deadline. A claim that a particular law requires keeping a record must identify that record and legal duty; it does not create a blanket right to retain your other information.
Privacy and service providers
The privacy policy explains the information collected, its uses, recipients, retention, and your choices. We do not sell user data for profit or other payment, and we do not monetize Veteran health data through targeted advertising.
Third-party use or disclosure of user information for any reason requires your consent. This includes de-identified, anonymized, and pseudonymized information. Service providers and contractors must follow the same commitments to you about use and disclosure.
Providers may have separate terms for a service you use directly. An independent hospital, website, or recipient's device is not controlled by VIPCall. A link to a third-party service does not mean we endorse its content or privacy practices.
Our content and software
We and our licensors own the service software, design, trademarks, and other content we provide. We give you a limited permission to use them through VIPCall for their intended purpose while your access is authorized.
Do not copy, sell, redistribute, or exploit our software or content beyond the permission these terms or applicable law allow. Do not remove ownership notices. These limits do not transfer ownership of content you provide to us.
Tell us about a suspected copyright violation at support@vipcall.ai. Include enough detail to identify the work, disputed material, your authority to report it, and a contact method. Do not attach private medical records to an ordinary email report.
Service changes and account suspension
We may change features, pause service, or restrict an account to address security, legal duties, or a violation of these terms. Service can also be interrupted by maintenance, outages, or a provider's failure. We do not promise uninterrupted availability.
If we suspend or close an account, payment and refund rights remain subject to the applicable purchase terms and law. Suspension does not remove your right to request deletion or extend the stated deletion period.
Ownership changes and service closure
We will notify users of an ownership change. A successor that continues VIPCall must follow privacy commitments consistent with the prior policy. You may close your account and request permanent deletion if you do not want to continue.
If the service closes without a successor, we will notify users and provide a way to request secure disposal of their information. We will stop new collection, close connections, and handle remaining copies under the deletion commitment. We will not keep medical records indefinitely because the business ends.
Electronic notices and changes to these terms
You agree to receive service and account notices electronically, using the contact information or app controls you provide. Keep your email address current. This does not replace a legally required consent or permit a marketing message that requires separate consent.
We will post changes to these terms and the privacy policy with an updated date and notify users. When a change materially affects your rights or health information, we will give clear notice before it takes effect when practicable. We will obtain a new agreement or consent when required.
Continued use does not replace consent required by law. If you do not agree to a change, you may stop using VIPCall, close your account, and request permanent deletion.
Warranties and limits
To the extent the law allows, the service is provided as is and as available. We do not give an implied warranty of merchantability, fitness for a particular purpose, or non-infringement beyond any warranty the law requires. We do not promise that content or AI output is accurate or that every fault will be corrected.
To the extent the law allows, we are not liable for indirect, special, incidental, or consequential losses arising from use of the service. These can include lost profits, lost business, or loss caused by a provider outage or an event outside our reasonable control.
To the extent the law allows, the total liability of GetMotivatedBuddies, Inc. and its affiliates, officers, employees, and agents for claims under this agreement is limited to $100. A claim relating to the service must begin within one year after it arises, unless the law requires a different period.
Some laws do not allow particular warranty exclusions, damage limits, or time limits. Those exclusions or limits do not apply where prohibited. Nothing in these terms waives a right or duty that cannot lawfully be waived, including an applicable health-privacy duty.
Responsibility for claims
To the extent the law allows, you agree to cover claims, losses, and reasonable legal costs caused by your unlawful use of VIPCall, your violation of these terms, or your infringement of another person's rights. We may manage the defense of such a claim and ask for reasonable cooperation.
This does not make you responsible for our violation of law or waive a privacy right you have. Any release of claims about another user's conduct applies only to the extent permitted by law. We cannot guarantee that a court will enforce a particular limitation.
Disputes
First contact support@vipcall.ai about a dispute so we can try to resolve it. Describe the issue and the result you seek. Do not include medical documents in an ordinary email.
If we cannot resolve a dispute, you and we agree to final, binding arbitration of claims arising from this agreement or use of VIPCall, except for a qualifying claim in small claims court or another exception required by law. Arbitration has no jury, and court review of an award is limited.
The American Arbitration Association will conduct the arbitration under its applicable consumer rules. The arbitrator applies these terms and applicable law and may award the relief the law permits for an individual claim. The arbitrator decides questions about the arbitration agreement to the extent permitted by law.
You and we agree to bring claims individually, rather than as a class member or in a representative proceeding, to the extent the law allows. The arbitrator may not combine different users' claims without agreement or award relief for people who are not parties to the individual proceeding, except where required by law.
California law governs this agreement without its conflict-of-law rules, except where another law must apply. If a dispute is not subject to arbitration, the applicable state or federal courts in the California county of our principal office will hear it, subject to any mandatory legal right to another forum.
General terms
If a term is unenforceable, the remaining terms continue to apply to the extent permitted by law. A delay in enforcing a term does not waive it. These terms and the documents they incorporate form the agreement about VIPCall, subject to any separate terms you accept for a purchase.
We may seek a lawful court order to protect against misuse or infringement. Remedies remain subject to applicable law. These terms do not prevent you from making a lawful report to a regulator or exercising a right that cannot be waived.
